1. Purpose and seller

These terms govern the sale of sponsored places in Kaizen Launcher by Sylvain LIMOUZY, sole proprietorship (EI), trading as SP Modding, SIREN 109 265 934, 173 rue de Courcelles, 75017 Paris, France, contact@kaizen-dayz.fr, phone +33 6 52 24 38 96 ("the seller") to any holder of an owner space account ("the buyer").

2. Services

A sponsored place is the display of a DayZ server in Kaizen Launcher for one whole day, from midnight to midnight, Paris time: "Featured" (the big banner of the home page and the first card of the list's band, 1 place a day), "Premium" (one of the 2 large cards of the home page and the list's band, 2 places a day) or "Promoted" (one of the 12 cards of the home page, 12 places a day).

Servers of the same level are shown in a random order. A place only shows while the server is online. The seller guarantees neither a number of players nor a number of views; the statistics in the owner space are indicative.

3. Ordering conditions

Only a server the buyer claimed in the owner space and that is online at the time of purchase can be featured. Days can be booked from the same day to the 28th day after; a day bought on the same day counts in full. A server has at most one place a day and 7 consecutive days at the same level. The minimum order is €2.00.

4. Prices

Prices are in euros, all taxes included. VAT not applicable, article 293 B of the French General Tax Code.

Featured: €6.00 a day, €36.00 for 7 consecutive days. Premium: €3.50 a day, €21.00 for 7 consecutive days. Promoted: €2.00 a day, €12.00 for 7 consecutive days. The price that applies is the one shown when ordering.

5. Order and payment

The buyer picks the server, the level and the days, which are held for 15 minutes during payment. Payment is made with PayPal. The order is final once the payment is confirmed; days not paid within 15 minutes are released. An invoice is issued for each payment and remains available in the owner space.

6. Performance and right of withdrawal

The service is performed on the days chosen by the buyer. By ticking the box when ordering, a consumer buyer requests performance on those dates, including before the end of the 14-day withdrawal period, and acknowledges losing the right of withdrawal for days fully performed (article L221-28 of the French Consumer Code).

For days that have not started yet, a consumer may withdraw within 14 days of the payment, without giving any reason: online, with the "Withdraw from the contract here" button on the order page in the owner space, or by sending the seller the withdrawal form below or any other unambiguous statement. An acknowledgement of receipt is provided.

Days already performed remain due, pro rata (article L221-25); the rest is refunded through the payment method used, within 14 days of the withdrawal at the latest, with a credit note.

7. Offline guarantee and credits

If a booked server is offline for more than 120 minutes in total during a paid day, according to the Kaizen Launcher directory's checks, the buyer automatically receives a one-day credit at the same level for that server, valid 3 months. If the directory or the launcher is unavailable for more than 2 hours in a day through the seller's fault, a credit is granted for every place of that day.

Credits replace a payment for one day and are not refundable in money, unless required by law.

8. Usage rules and cancellation

The server's name, profile and images must contain no unlawful, shocking or misleading content, nor advertising for another service. If these rules are broken, the seller may remove the profile, cancel upcoming places and suspend the buyer's account.

Every day cancelled by the seller is refunded: a paid day is refunded pro rata to the order's price, through the payment method used, with a credit note; a day paid with a credit gives that credit back.

9. Liability

The seller uses reasonable means to show the places bought. It is not liable for a faulty performance due to the buyer (in particular an offline server, covered by the guarantee of article 7), to the unforeseeable and insurmountable act of a third party to the contract (Steam, PayPal, Discord) or to force majeure (article L221-15 of the French Consumer Code).

Towards a professional buyer, its liability is limited to the amount of the order concerned. This limit does not apply to a consumer or non-professional buyer.

10. Legal guarantee of conformity

A consumer buyer benefits from the legal guarantee of conformity of digital content and services (articles L224-25-12 and following of the French Consumer Code). As a place is supplied during the days bought, the seller is liable for any lack of conformity that appears during those days, and it is for the seller to prove that the service was in conformity.

In case of a defect, the consumer can ask for the service to be brought into conformity, free of charge, by writing to contact@kaizen-dayz.fr. If this is refused, impossible, unjustifiably delayed or unsuccessful, or if the defect is serious enough to justify it, the consumer can obtain a price reduction or end the contract and be refunded. This guarantee applies regardless of the offline guarantee and credits of article 7.

12. Complaints and mediation

Complaints can be sent in writing to contact@kaizen-dayz.fr.

Under articles L612-1 and following of the French Consumer Code, if the dispute is not resolved after that written complaint, consumers can refer it free of charge to the seller's consumer mediator: CM2C — Centre de Médiation de la Consommation des Conciliateurs de justice, 49 rue de Ponthieu, 75008 Paris, France, https://www.cm2c.net. It can be referred online at https://www.cm2c.net/declarer-un-litige.php, no later than one year after the written complaint.

13. Governing law

These terms are governed by French law. The French version is authoritative; translations are provided for information.
